> GENERAL TERMS AND CONDITIONS OF SALE 

1. General

The general conditions of sale have been laid out by SARL Green RAILS, owner of the brands 727Sailbags and byAnna and apply to creations of the online shops wwww.727sailbags.com and www.byanna.fr. You certify that you have read and accepted theses terms and conditions of sale prior to placing your order. By confirming your order you agree to the conditions thereof.

2. Prices

Prices of the online shop creations are listed in euros including VAT, excluding postage.       

3. Payment

Payment for your purchases can be made by Debit Card, Visa,… In certain cases payment can be made via cheque. Cheques must be payable and sent to SARL Green Sails, rue Bourely Base des sous marins, presqu’ile de Keroman 56100 LORIENT, FRANCE. Cheques are paid in upon reception.

4. Postage and packing fees

Postage and packing fees are listed during check-out and include VAT. They cover metropolitan France, Europe or international destinations. The carrier Calberson delivers to your doorstep. Parcels can be tracked upon request. The customer should never sign a receipt without having opened and checked the parcel’s condition.

5 – Transport

SARL Green Sails may not be held responsible for any loss, theft or damage which may occur during transport. If the parcel has been delivered and the customer has signed for its receipt without mentioning any fault, he may under no circumstance hold SARL Green Sails responsible.

6. Delivery times

Products are shipped to the recipient upon receipt of orders and once payment has cleared. Delivery times are 3 to 15 working days for metropolitan France and a minimum of 8 working days for the French overseas departments, non-metropolitan France, Europe and international destinations. For special orders, delivery times shall be no less than 15 working days following payment receipt and clearing unless otherwise arranged.

Payment by cheque: SARL Green Sails reserves a 4-week clearing delay, which corresponds to how long an unpaid cheque will take to bounce.

SARL Green Sails cannot be held responsible for delays caused by strikes by carriers.

7. Product quality

727sailbags and 727sailbags byAnna are products crafted from recycled materials. They are of honest and merchandisable quality. Rust spots and black stains for example, caused by the material’s previous use cannot be considered as defects.  Likewise, tears, and other deteriorations of the material cannot be considered defects.

8. Retraction

The customer has a 7-day period to exercise his right of retraction upon receipt of the goods. Return fees will be paid by the buyer. Past this delay, products will be neither exchanged, nor refunded. In case of retraction, refunds will be made by cheque.

9 – Copyrights and design protection

All creations by 727sailbags and byAnna are subject to copyright. Most models are filed at the National Institute for Industrial Property (INPI). Any reproduction or copies are strictly prohibited. Any natural or moral person using one of the creations by 727Sailbags or byAnna for promotional purposes without written consent of SARL Green Sails will be prosecuted.

10. Information privacy

Personal information and data are required for the processing of your order and our trade relations. They remain in the sole context of this use by SARL Green Sails for the brands 727sailbags byAnna. In accordance with the Privacy and Data Protection Act 6^th January 1978, you have a right to access and correct or oppose any personal data that concerns you.

Distributor

1 / General: These terms of sale were established by Green Sails Sarl. You are agreeing your order, you declare to have read and accepted these terms and conditions of sale.

2 / Prices: Prices are in euro excluding taxes and do not include shipping.

3 / Payment: The payment of your purchases is by credit card or bank transfer. To open an account, payment is made to order. No deliveries will be made without payment. The packs are payable by credit card. The selections are 100% payable to the order.

Any delay in payment will be awarded late penalties *.

4 / Command and selection of creations: the Green Sails Ltd selects creations, possibly the distributor has the ability to choose its products in the showroom. If the customer requires specific products, they will be charged at the cost of goods made to measure.

5 / Transport: The port is charged to the customer under a fee schedule available upon request. All international shipping will be an increase in shipping costs. The Green Sails Ltd is not responsible for any loss, theft, product damage which might occur during

transportation or any weather delays or carrier. Delivery times are 30 days to pack out all orders and 20 days for the packs.

6 / Product quality: the creations of brands and 727sailbags byANNA are unique, made from recycled materials. They are of merchantable quality. Traces due to living matter can not be considered a defect.

7 / Exchange of merchandise, you have a period of 14 days after receiving your goods to exchange one (1) product that is not to your liking. Logistics costs will be borne by the distributor. After this time, no product will be returned or exchanged.

9 / Validity of rates: Rates are valid until January 31, 2012, unless otherwise indicated by the LLC Grenn Sails.

* Late payment: 1.5 times the legal interest rate per month (Act No. 92-1442 of 31 December 1992)
